A US judge in New Hampshire has once again blocked President Donald Trump’s executive order aimed at ending birthright citizenship, issuing a nationwide injunction.

US District Judge Joseph Laplante ruled that the plaintiffs could be certified as a class and extended the injunction to cover the entire country, effectively halting the implementation of the executive order.
Laplante’s ruling is particularly significant as it comes in the wake of a recent US Supreme Court decision that limits the authority of district court judges to issue nationwide injunctions unless the plaintiffs in a case are certified as a nationwide class. In this case, Laplante found that the plaintiffs, who had asked to represent all babies whose citizenship could be affected by Trump’s order, met the standard for class certification.
The Supreme Court, in its 6–3 ruling, had not weighed in on the constitutionality of Trump’s order, but it did restrict the scope of district court injunctions. By certifying the class and issuing a nationwide injunction, Laplante’s decision demonstrates that legal challenges to Trump’s birthright citizenship order still have a viable path forward.
